Look, 1) this is the government’s position, and, if you accept the view of Padilla, only one District Court with proper jurisdiction has held otherwise; and 2) there is no evidence that this has been done systemically.

Also, context is lacking. In what case did they say this. I didn’t think that there were any EC cases pending in EDNY. Or is this the Syrian 1983 case ?
