I'm sure they'll be doing that indiscriminately, since the government exists to arbitrarily harass random people. They surely won't be targeting or profiling potential terrorists. And of course, the constitution protects not just American citizens, but everybody in the world.

This whole terrorism thing is totally overblown anyway. They don't wanna hurt us, they're just making a point.

Look, 1) this is the government’s position, and, if you accept the view of Padilla, only one District Court with proper jurisdiction has held otherwise; and 2) there is no evidence that this has been done systemically.

Also, context is lacking. In what case did they say this. I didn’t think that there were any EC cases pending in EDNY. Or is this the Syrian 1983 case ?
