When Prosecutors Misbehave...

I know I'm a bit late on this, but it's the sort of thing that is just taylor made for Indefensible. According to this report out of Minnesota the Minnesota Supreme Court has reversed a conviction citing prosecutorial misconduct on an "unprecedented" scale. The Prosecutor, then-Clay County Attorney Lisa Borgen compromised the case by improperly commenting on the defendant's credibility, inflaming the jury's passion, intentionally misstating evidence and making other missteps the high court said.

So what else did she do? She made 15 references to an alleged prior shoot-out between the defendant and the victim that was never actually proven to have occurred.

And what happened to her after this stunning slap down? She's a judge, of course.

and, she was a contract public defender from 97-99 before she was a prosecutor. wonder which job gave her the trial training for that closing. hopefully, it wasn't one of our own.

hey yall

I know this woman lisa borgen and iv seen her many times .. but never talked to her.. iv been to the courthouse to pay my speeding fines and iv seen her walk in that suit and mini skirt and has nylons on. she looks kinda like a hot older mama. i think i would bed her if she begged me to.

but she is one arrogant, proud bitch who loves the media attention and loves the publicity...

TRUST ME.. everyone i know seems to have a bad opinion on her..

Clay County District Court Judge Lisa Borgen is being investigated for her actions while prosecuting a 2004 murder conviction recently thrown out by the Minnesota Supreme Court, which cited Borgen’s “unprecedented” misconduct.

Martin Cole, director of the Minnesota Office of Lawyers Professional Responsibility, confirmed an investigation is taking place, but would not comment on how it began.

Cole said such an investigation can begin when his office’s board approves an inquiry or when someone filing a complaint.

Borgen, former Clay County attorney, declined to comment, saying she is not allowed to as a judge.

She has been a member of the Minnesota Bar since May 9, 1997, and has never been publicly disciplined or investigated, according to Minnesota records.

Mr. Borgen has a history of being overzealous, unfair, and even racist. She has made a reputation for herself that now preceeds her. I too was shocked to see her antics rewarded with a judgeship. Did she really think that justice would never chatch up to her? I guess what goes around does come around.

I ran accross an old post of yours on Lisa Borgen. Just so you know, Clay County, Mn. is footing the legal bill for her defense. It's a real hoot. The Mn. Supreme Court says she committed misconduct, but why let the facts get in the way? Ben Gershmann found the decison to be unique in its specificity. And as to her being appointed a Judge, Tim Pawlenty was into appointing 40 something women to the bench that year. She wasn't the only one.

Unfortunately I have had the "privilege" of running into Borgen in the courtroom. In my opinion she is not qualified to be behind the bench because she cannot and will not leave her "personal" feeling at the door. She uses her position in power as a weapon rather than a tool of justice. In my opinion.

Just a note to let you know that she has been cleared of any and all charges brought against her, without even a slap on the wrists. It goes to show that as long as you have money and "friends in high places" the law does not apply to you. If only it could be like that for the working class, just trying to get by, unfortunatly made a bad judgement call and are now paying for it on every level possible not just the financial, kind of people.

And the really interesting part of Boren being cleared is that the County paid $35,000 to defend her. Of course, in Mn., only 5 percent of charges brought against an attorney ever result in a public reprimand.

What a loss for our society to have such a waste of time, money , and resources with Lisa Borgen on stand. Just goes to show how corrupt it is in Clay Coounty. Gets worse as you move into Glyndon with the Chief of Police! Hey go EAST, there's actual justice served in ND.

She is not a racist, if I remember correctly she and her husband adopted their three children from Haiti (before it was hip). As far as arrogant or any other personal shortcoming; I beg you to do better when every other comment is either about sleeping with her, about her being a bitch, or about her being too young for the job, Jeesh

Becouse I'm the friend of innocent man that was put in prison He know lisa realy good and he know how currapt she is.I know my friend for many years and he will never hurt no body.He spend 10 years behind bars becouse of Lisas Unjust and unfar prosecution.My friend is a father of three children and he had no oppertunity to see them for 10 years.Soon He is going to meet his son for first time.And I just would like to shere this with you people to let you know that Lisa Borgen is a unjust,unfar and races bitch no question ask.

she agreed to let a known convicted sex offender in the state of mn to be let off without having to even register on a plea bargain. the man admittedly molested 35-45 children between here and or as well as having sex with live and dead animals. at the very least he should be a REGISTERED SEX OFFENDER!!! our justice system certainly leaves a bit to be desired. wish i could do something about this...

Lisa is a fair judge. I had her for a trial. Looking back I would say she could of made things alot harder for me and really helped me out with the 90 days in jail. Look
folks that is a hard job. I think she is doing a good job for Clay County. As far as her looks come on she is very beautiful. All this
talk about that is so of key.

hello people i been in court with the lady and she went againest codes of law and i am here too press out asking for help from the supreme courts and you all while back she let two people get away with dwi i dont see why she is still judge people anyone knows if a judge under codes violed codes under minnesota state will lose there lic of being anything and i dont see what is with the supreme courts i had lost two who i loved and she saw the look on someone and still let two people get away with dwi now what is up hope i get the help now after been few yrs i been trying too find help but got busy
